The terms in this Agreement are a legally binding contract between you and Pizza Oven USA . By using any of the services that we provide, even if you are just browsing, you acknowledge that you agreeing to the terms. If you do not agree with said terms, you may not use our services.

 

1. Use of Our Services.

1.1. Pizza Oven USA provides a marketplace where buyers can find and purchase goods from multiple sellers. When a sale occurs, the said sale is made between the Buyer and the Seller, therefore is governed by the Conditions of Sale and this Agreement. Our terms of service for everyone include our Privacy Policy, Shipping Policy, and Refund Policy.

1.2. Agreeing to these terms do not in any way create an agency, employment, franchisee, or partnership between Pizza Oven USA and yourself.

2. Your Account with Pizza Oven USA .

2.1  Your account grants you access to the features and services that Pizza Oven USA establishes and maintains. Modifications do happen from time to time and are at the sole discretion of Pizza Oven USA . If you connect to Pizza Oven USA through a third-party service, you acknowledge that you give us permission to access and use any information that said service permits, in addition to storing your login credentials for said service.

2.2   You must be 18 years or older to create an account with Pizza Oven USA .

2.3   You the user are responsible for your account and are responsible for all activity that occurs under your account(s). If you are sharing your account with others, the persons whose financial information is on record will be the individual who is ultimately responsible for the account and its activity. We believe honesty is the best policy, so be sure to provide accurate information about yourself. It is prohibited to provide false information and/or pose as another person or business. If you choose to not use your full name for your account, be sure to choose one that is appropriate. Language that is offensive, foul or infringes on another copyright is strictly prohibited. If you are registering under a business name, you ensure that you have the authorization to register under that entity. Your responsibility as an account holder includes tracking all your account activity, include but not limited to:

1. Storing all usernames and passwords securely.
2. To notify Pizza Oven USA if there has been any unauthorized use or other violation of security. Pizza Oven USA will not be held liable for any cost, damage, expense, liability, or loss in connection to or caused by unauthorized use of your account.
3. To never selling or transferring your account to another person or business is as it’s prohibited

 

3. Right to monitor your account(s) with us.

3.1  Pizza Oven USA understands you’re your privacy is important to you. Here in our Privacy Policy, we outline exactly how your information is used. By using our services, you are agreeing to our Privacy Policy and how your personal information is managed within our site.

 

3.2   To ensure compliance with our Terms, which may be updated at any time, Pizza Oven USA reserves the right to monitor user activities. We may change or stop certain services and/or features without notice. We may without liability or notice, temporarily or permanently suspend your access to services for any reason or without reason. Pizza Oven USA may not allow or choose to remove any user content for any reason or without reason. You will continue to be bound by these terms and conditions if there is termination for any reason or no reason.

4. Your use of our Service.

4.1. Pizza Oven USA provides an online marketplace for authorized sellers to market and sell their goods to potential buyers. You may only use our services for lawful purposes and in accordance with these terms.

 

4.2. You are prohibited from using Pizza Oven USA in the following ways:

• In any way that violates local, state federal, or international regulations or laws.
• For attempting to or exploiting or harming minors in any way. This includes but is not limited to asking them for personally identifying information, by exposing them to inappropriate content, or any other action that can be deemed harmful.
• To participate in a way that harms, restricts, or prevents another user or Company from using or enjoying the website, as determined by Pizza Oven USA in our sole discretion.
• To knowingly receive, send, download, upload, or reuse any products that are not in compliance with the Standards that we have stated in these agreements. This includes but is no limited to the transmission of advertisements or promotional products, spam, or junk mail without prior written consent.
•  To use any actions in which could damage, disable, impair, interfere, or overburden the site or another user’s use of the site.
• To attempt to or to impersonate Pizza Oven USA, an employee of Pizza Oven USA, another user, or any other entity or person.  This includes but is not limited to the use of email addresses, screen names, usernames, or other that can be associated with the above mentioned.
• To use any device, software, process, that monitors, copies, or uses any information within the website for any unauthorized purposes.
• To introduce any malicious or potentially harmful technology including but not limited to any logic bombs, Trojan horses, viruses, or worms.
• To attempt to or to gain unapproved access to, damage, disrupt, or interfere with any parts of Pizza Oven USA , the server, the server on which the website is stored, or any computer, database or server connected to the website. 
• To attempt to or to inhibit the correct functioning of the Website. 

5. Your Content.

5.1.Content that you post on Pizza Oven USA, including but not limited to your comments, product photos, product descriptions, shop name, profile picture, reviews, or usernames is your content, therefore we will not make claim to it. You understand that you are solely liable for your content and that the Content Standards apply wholly to all usage and items offered within our services. Based on the sole discretion of Pizza Oven USA, we may remove or refuse to post any user content for any reason or no reason. You represent that you hold all rights and claims to your content and that you are not infringing on any third parties’ rights by posting/listing it.  All items must obey all local, state, federal and international laws, and regulations. Items must also not:

• Contain any product that at the discretion of Pizza Oven USA be considered abusive, derogatory, discriminatory, hateful, harassing, indecent, obscene, objectional, or violent.
• Promote sexually explicit or adult products and or products discriminate or promote violence against another based upon age, disability, nationality, race, religion, or sexual identity or sexual orientation.
• Violate another’s public or private legal rights or include any products that produce any liability under laws or regulations, or that conflict with these terms.
• Deceive any person, including but not limited to misrepresenting your identity or any affiliation that you may have with another individual or company.
• Infringe on others’ rights as a person or company by violating on any copyright, intellectual property, patent, trademark, or trade secret.

5.2.By posting your content you acknowledge that you grant Pizza Oven USA license to use it. Granting permission to use your content doesn’t grant any ownership but allows for Pizza Oven USA to promote it and helps us operate and grow. Pizza Oven USA may offer promotions within the site that could relate to your content. For instance, when you post your content, you grant Pizza Oven USA a worldwide, royalty free, comprehensive license to edit, distribute, display, reproduce, modify, promote, and store your content. Granting Pizza Oven USA these rights allow for us to promote our services.

6. Products, Price(s), Fees, Paid Services and Refunds.

6.1.Price Match/Adjustment. You acknowledge that other marketplaces offer different, probably lower, prices of the products sold in our website. That notwithstanding, the prices for the products in our website are fixed and are determined by the sellers thereof. The said prices shall therefore be subject to review in the sellers’ discretion. However, the Sellers are encouraged not to fluctuate their prices unnecessarily.

 

6.2.All information provided at the time of purchase must be accurate, current, and complete. By making a purchase you agree to pay all charges incurred by any users of your payment method. You are responsible for any applicable taxes related to your purchase per our payment policy

6.3.When you make a purchase, you understand that all refunds are at the sole discretion of Pizza Oven USA, and are governed by our Returns & Refunds Policy.

**All items are in stock, except for the made to order products that are mentioned on the product page . Production of made to order items begins only after a customer order is received. The consumer is always required to wait between one and six months for the completed product.

7. Limitation of Liability.

7.1.You understand that you release Pizza Oven USA from any claims in connection to items sold through our services, including defective items or items that were misrepresented by the seller and that any legal claim (including without limitation and liability claims) made must be brought against the seller of the item. You acknowledge that Pizza Oven USA is not responsible for the accuracy, copyright compliance, decency, or legality of items that sellers have posted that you have accessed through our services, and you release us from all liability in connection with such exchanges.

7.2. To the fullest extent permitted by law, in no event will Pizza Oven USA, its affiliates or their licensors, agents, directors, employees, service providers, or officers be responsible for damages of any kind, under any legal theory, arising out of or in relation with your use of, any content or items accessed through or on the website or such other websites or any services or items obtained through the website or such other websites, or inability to use, the website, any websites linked to it, including any consequential, direct, indirect, incidental, special, or punitive damages, including without limitation personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

 

7.3. In no event will Pizza Oven USA, its affiliates or their licensors, agents, directors, employees, service providers, or officers be responsible for damages whatsoever resulting from:

• Any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein.
• Any interruption or cessation of transmission to or from our service.
• Any bugs, viruses, Trojan horses, or the like, which may be transmitted to or through our service by any third party.
• Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the service.

This applies regardless of legal theory, even if Pizza Oven USA is advised of the possibility of such damages.

 

7.4. You understand and agree that Pizza Oven USA cannot be held responsible for:

• The content posted by users on our platform, including any defamatory, offensive, or illegal material.
• Any harm or damage caused by such content.

You are solely responsible for your own use of the platform and any risks associated with it. This disclaimer applies to the fullest extent permitted by law.

 

8. Indemnification.

You consent to hold harmless and indemnify Pizza Oven USA , its agents, directors, employees, licensors, officers, suppliers, representatives, or other partners from any awards, claims, costs, damages, demands, expenses or fees (including reasonable attorneys’ fees), liabilities, or losses made by any third-party due to, arising from, or in relation to your use of any kind including violating of any rights of another or these terms, including but not limited to any use of content, services, purchase or sale of any products from our website. You acknowledge that even with your indemnification, you agree to cooperate with Pizza Oven USA as we retain sole discretion of our legal defense and strategy. 

9. Disclaimer Damages and Warranties.

You acknowledge that Pizza Oven USA provides the marketplace and that the products are provided “as is” and are listed, produced, and sold through independent sellers. Pizza Oven USA does not make any expressed or implied warranties and disclaims any implied accuracies, conditions, results, reliability, or warranties of the use of the products on the Pizza Oven USA  platform. Pizza Oven USA is not liable for any corruption, harm, or loss to your computer system or data, or any other harm that may result from the use of Pizza Oven USA .

 

10. Copyright Infringement and Intellectual Property.

10.1.   Pizza Oven USA takes Copyright Infringement and Intellectual Rights very seriously. We comply with industry best practices and intellectual property laws in order to maintain the integrity of our platform. It is our policy that we will disable and/or terminate the account(s) of repeat offenders under the appropriate circumstances.

10.2.   There may be times that Pizza Oven USA will request additional information, such as documentation regarding the claimed right, or identity verification of the reporting party before processing a notice. Pizza Oven USA is also authorized to reject notices or counter notices that contain information that we believe is incomplete or submitted in bad faith, false, or fraudulent. Pizza Oven USA also has the authority to act against those that may abuse this policy.

10.3.   If you believe that any content infringes on your copyright, or if you are an agent representing thereof and wish to have the alleged infringing product removed, you must submit the following information to us in writing to request removal of said item at grillmaster@pizzaovenus.com

• The electronic or physical signature of the copyright holder or an authorized person to act on behalf of the copyright holder.
• Precise identification of the product, including the location (to allow us to locate product) in which you believe infringes on your copyright. If the claim includes multiple items, provide a list of such products.
• Information in which allows us to contact you, such as an address, email address, and telephone number.
• A statement that the information that you have provided has good faith belief that the information is accurate and under penalty of perjury, that you are the copyright owner or an authorized person representing the copyright holder.

11. Changes and Updates.

11.1 At our sole discretion, Pizza Oven USA may revise and update these Terms from time to time. Unless otherwise stated all changes that are made are effective immediately. You, as a user are responsible for regularly checking this page to review any changes as you use of services after the changes have taken place signifies you have agreed to these changes.

11.2 Pizza Oven USA or our sellers may also update products or services offered from time to time. As a result, some products may be out of date or not available from time to time, and there is no obligation to Pizza Oven USA to guarantee that said products are revised and available.

12. Electronic Communication.

You acknowledge that communications between Pizza Oven USA and you will be done electronically. By continuing use of Pizza Oven USA you consent to receive all communications, including but not limited to all Terms and Conditions, agreements, disclosures, email, and other notices through electronic form.

13. Consent and Collection and Use of Data.

13.1.   When you purchase a product, you do so with the acknowledgement that the Seller in which you purchased from will have access to your purchase information, such as your username, the products purchased, date of purchase, as well as any other information that you have publicly available. The seller will not have access to any payment methods, credit card information, or your email address.

13.2.   By using our services, you consent to the collection, processing, storage, and use of your personal data as state within our Privacy Policy. You agree that it is your responsibility to acquire all necessary consents, and for complying with all data protection, privacy, or any other applicable laws.

13.3.   Third Party Services, such as other companies or social media platforms are responsible for their own privacy practices. Be sure when accessing all platforms and website that you read and review their notices, privacy policies, terms and conditions, and settings so you are aware of their practices, and you understand your options. 

14. Account Termination.

14.1  Although we hope that you don’t, if you decide that you wish to terminate your account, you are able to do so through your account settings.

 

14.2 Pizza Oven USA reserves the right to monitor user activity and is authorized terminate or suspend your account(s) in addition to any accounts that we may conclude are related to your account if we determine that you, your activity, or your content violates these terms or for no reason. We may temporarily or permanently suspend or terminate your access without liability or notice for any reason. If your account is terminated, either by you or Pizza Oven USA , you may lose all content and/or information associated with your account. You will continue to be bound by these terms upon termination, for any reason or no reason.

15. Severability and Waiver

15.1.   Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law. The remaining provisions will continue in full force and effect.

15.2.   Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Terms shall not effect a party's ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.

 

16. Dispute Resolution

16.1.If there is any dispute between the Seller and You, You grant us the right to talk on your behalf. We will work with both parties to the dispute to arrive at a settlement.

16.2.If You have any concerns or disputes about the Platform, You agree first to try to resolve the dispute informally by contacting us. If that fails, the dispute will be settled in a court of law. Venue for any litigation under this Agreement shall be any court of competent jurisdiction in Massachusetts, U.S.

16.3.This Agreement shall be interpreted according to the laws of Massachusetts, U.S.

18. Billing Terms of Service

Accuracy of Billing & Account Information
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting your e-mail.
